📱 Using Your Phone (and Other Devices) While Driving — What’s Actually Legal?

Technology is part of everyday life. From phones and sat navs to in-car touchscreens, these tools can be incredibly useful — but they can also get you into trouble if used incorrectly while driving.

Let’s cut through the confusion and help you stay safe, legal, and confident behind the wheel — with clear advice and real-world tips from someone who teaches this every day.

🚫 What the Law Says: The Basics

In the UK, it’s illegal to hold and use a mobile phone or similar device while driving.

  • 📱 Mobile phones
  • 🛰️ Sat navs
  • 📟 Tablets
  • 🎵 Media players
  • 🖥️ Touchscreens (if not hands-free)

This still applies even if you’re:

  • Stopped at traffic lights
  • In a traffic jam
  • Pulled over but the engine is still running
💡 Rule of thumb: If the engine’s on and you’re in the driver’s seat, you’re still classed as driving.

✅ When Can You Use a Device?

You’re allowed to use a device only when:

  • 🔌 You're safely parked with the engine off
  • 💳 Making a contactless payment in a stationary vehicle
  • 📞 Calling 999 or 112 in an emergency
  • 🎤 Using fully hands-free tech (like voice control or steering wheel buttons)

⚠️ Never hold the device in your hand, even briefly.

🤏 Is Tapping a Screen Illegal?

Not always — but be careful.

Tapping a mounted screen or dashboard display isn’t automatically illegal — as long as:

  • The device is not in your hand
  • It doesn’t affect your driving or control of the vehicle

But you could still be prosecuted under other driving laws if it causes distraction.

⚖️ Other Offences You Could Be Charged With

1. 🚧 Driving Without Due Care and Attention

Poor lane discipline, slow reactions, or a momentary lapse caused by tech use.

Penalty: Unlimited fine, 3–9 points, possible disqualification

2. 🛑 Not Being in Proper Control of the Vehicle

Fiddling with a device can be enough — even if you didn’t mean to.

Penalty: £100 fine + 3 points (more in court)

3. ⚠️ Dangerous Driving

When tech-related distraction leads to serious risk to others.

Penalty: Driving ban, unlimited fine, up to 2 years in prison

👨‍🏫 My Advice as a Driving Professional

Even if something is technically allowed, that doesn’t make it safe.

🔕 Don’t use any device unless it’s absolutely necessary.
📞 Take or make calls at the end of your journey.
🅿️ If it’s urgent — park safely, switch the engine off, then call or text.
👀 Your focus should always be on the road — not the screen.
